1 The Terms of Use
1.1 Acceptance of these Terms
These Terms & Conditions govern your access to and use of the Bambini website, together with the purchase of any products from Bambini Prams Pty Ltd (ABN 84 628 952 205) ("Bambini", "we", "our" or "us").
By accessing our website, placing an order or purchasing a product from us, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions and our Privacy Policy.
If you do not agree to these Terms & Conditions, you must not use our website or purchase products from us.
1.2 Changes to these Terms
We may update these Terms & Conditions from time to time.
Any changes apply to orders placed after the updated Terms & Conditions become effective. Orders placed before that date remain subject to the Terms & Conditions that applied at the time the order was placed, unless otherwise required by law.
The current version of these Terms & Conditions will always be available on our website.
1.3 Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
Where these Terms & Conditions refer to Bambini policies relating to returns, refunds, warranties or cancellations, those policies operate in addition to your rights under the Australian Consumer Law.
2. Ordering & Payment
2.1 Placing an Order
Orders placed through the Bambini Website, Sydney Showroom, Baby Expos or other authorised sales channels are an offer to purchase products from Bambini.
All orders are subject to acceptance by Bambini and product availability.
Once your order has been accepted, we'll send an Order Confirmation to the email address provided. Please carefully review your Order Confirmation to ensure your details, products, colours, quantities, delivery address and payment details are correct.
2.2 Pricing
All prices displayed on the Bambini Website are shown in Australian Dollars (AUD), New Zealand Dollars (NZD) or United States Dollars (USD), depending on the selected currency.
Prices are subject to change without notice.
Once an order has been accepted by Bambini, the purchase price is fixed and will not be adjusted to reflect subsequent price increases, price reductions, promotional offers or discount campaigns.
Pricing may vary between our Website, Sydney Showroom, Baby Expos, authorised retailers and other sales channels. Promotional pricing offered through one sales channel (including Expo Offers) does not automatically apply to purchases made through another sales channel unless expressly stated.
2.3 Payment
Payment must be successfully received before your order can be processed or dispatched.
We currently accept payment by Visa, Mastercard, Debit Cards displaying the Visa or Mastercard logo, PayPal, Direct Bank Transfer, Approved Bambini Payment Plans and Bambini Gift Cards.
All online payments are processed through secure payment providers.
To protect our customers and business from fraudulent or unauthorised transactions, Bambini may, where reasonably necessary, delay processing or dispatch of an Order while payment or identity verification is completed. Bambini may request additional information to verify an Order, including proof of identity, proof of address, confirmation of payment details or other information reasonably required to confirm that an Order is genuine. Failure to provide requested information within a reasonable time may result in the Order being delayed, suspended or cancelled.
Bambini reserves the right to refuse, suspend, delay or cancel an Order where payment cannot be successfully processed, where fraudulent or unauthorised activity is suspected, where requested verification has not been provided, or where Bambini reasonably believes it is necessary to protect its customers, business or payment systems.
Customers must notify Bambini of any payment dispute within five (5) business days of becoming aware of the issue.
2.4 Payment Plans
Where an order is purchased using an approved Bambini Payment Plan or layby arrangement, a minimum of 20% of the total order value is non-refundable where the order is cancelled or otherwise becomes subject to cancellation in accordance with these Terms & Conditions.
Further conditions relating to cancellations and refunds are outlined in Clause 5 and Clause 6.
2.5 Promotions, Discounts & Promotional Items
Promotional pricing, discount codes and special offers apply only during the advertised promotional period and cannot be applied retrospectively.
Orders are not eligible for refunds, credits or price adjustments because the purchase price subsequently increases or decreases, a promotional campaign commences or concludes after the order has been placed, a different offer becomes available after purchase.
Bambini Gift Cards may be redeemed in accordance with their published terms and conditions.
Discount codes must be entered at checkout prior to completing your purchase, cannot be applied after an order has been placed, must be used in accordance with their published terms and conditions, may not be combined with other promotions, discounts or offers unless expressly stated and have no cash value and cannot be redeemed for cash.
Complimentary promotional items are not redeemable for cash or credit, cannot be exchanged for alternative products unless required by Australian Consumer Law.
2.6 Sales Channels
Bambini products may be purchased through a variety of authorised sales channels, including the Bambini Website, Sydney Showroom, Baby Expos and authorised retailers.
Pricing, promotions, bundled offers, product availability, payment options and product inclusions may vary between sales channels.
Unless otherwise required by Australian Consumer Law, purchases are subject to the pricing, promotions and conditions applicable to the sales channel through which the order was placed.
2.7 Order Confirmation & Customer Responsibility
Customers are responsible for reviewing their Order Confirmation promptly after it is received.
Please ensure the following is correct; Customer details, Delivery address, Products ordered, Colours and quantities, Accessories or promotional items and Payment details.
Any discrepancies should be reported to Bambini as soon as reasonably practicable.
Bambini will use reasonable endeavours to accommodate requested changes prior to dispatch. Once an order has progressed to processing or dispatch, requested changes may no longer be possible.
3. Shipping & Delivery
3.1 Dispatch
Orders for in-stock products are generally dispatched from our Sydney warehouse within five (5) to seven (7) business days, provided payment has been successfully received.
Dispatch timeframes are estimates only and may vary due to order volumes, public holidays, operational requirements or circumstances outside Bambini's reasonable control.
Where an order contains a combination of in-stock and pre-order or back-order products, the order will generally be dispatched once all items are available, unless otherwise agreed by Bambini.
3.2 Delivery Estimates
Estimated dispatch and delivery timeframes are provided as a guide only and are not contractual commitments.
While Bambini will use reasonable endeavours to meet estimated delivery timeframes, delays may occur due to circumstances outside our reasonable control, including manufacturing schedules, customs processing, freight network delays, severe weather or other unforeseen circumstances.
Bambini will not be liable for any loss, expense, damage, inconvenience or consequential loss arising from delays outside our reasonable control.
Bambini may consolidate, split, reschedule or otherwise manage shipments where reasonably necessary for operational or logistical reasons. Such decisions may affect estimated dispatch or delivery timeframes but do not otherwise affect these Terms & Conditions.
3.3 Delivery Address
Customers are responsible for providing a complete and accurate delivery address when placing an order.
Bambini recommends providing a delivery address where someone is available to receive the delivery during normal business hours.
If an unattended delivery address is nominated, customers acknowledge that the delivery partner may complete delivery using Authority to Leave (ATL) where the delivery partner considers it appropriate and in accordance with its delivery procedures.
Bambini is unable to deliver to Australia Post Parcel Lockers unless otherwise agreed.
3.4 Delivery Attempts
Shipping charges include one (1) delivery attempt only.
Where additional delivery attempts, storage charges, return freight or redelivery fees are incurred because an incorrect delivery address was provided, nobody was available to receive the delivery, delivery was refused, or the shipment was not collected, the customer is responsible for any additional costs incurred by Bambini.
3.5 Tracking & Multiple Shipments
Once an order has been dispatched, Bambini will provide tracking information where available.
Tracking information may not become active immediately and will update once the shipment has been scanned by the delivery provider.
Orders containing multiple products may be dispatched in separate consignments and may arrive on different dates.
Customers are responsible for monitoring tracking information following dispatch.
Tracking information is provided by the delivery partner and may be subject to delays or temporary outages outside Bambini's control.
3.6 Delivery Issues
Customers must notify Bambini within fourteen (14) days of delivery if a product has arrived damaged in transit, a product is missing from the shipment, or an incorrect product has been supplied.
Failure to notify Bambini within this timeframe may affect our ability to investigate the matter with the delivery provider.
If you believe your product has developed a manufacturing defect, please refer to Clause 7 (Warranty & Remedies).
3.7 Delivery Completion & Proof of Delivery
Delivery is deemed complete when the delivery partner records the shipment as delivered to the delivery address provided by the customer, including where delivery has been completed under an Authority to Leave (ATL).
Where proof of delivery has been provided by the delivery partner, Bambini may rely on that proof when assessing claims relating to lost, stolen or undelivered products.
Proof of delivery may include delivery records, delivery scans, GPS records, photographic evidence or other records maintained by the delivery provider.
Nothing in this clause limits any rights or remedies available under Australian Consumer Law.
3.8 Shipping Costs
Shipping charges displayed at checkout are a contribution towards the cost of shipping and may not represent Bambini's actual shipping costs.
Where shipping costs are relevant to an approved return, refund or cancellation, Bambini reserves the right to calculate shipping using the actual shipping costs incurred.
4. Pre-orders & Back-orders
4.1 Back-orders
A back-order allows customers to purchase a product that is temporarily out of stock.
Where a product is purchased on back-order, Bambini will provide an estimated dispatch date where reasonably possible. Estimated dispatch dates are provided as a guide only and are not contractual commitments.
While Bambini will use reasonable endeavours to meet estimated dispatch dates, delays may occur due to circumstances outside our reasonable control, including manufacturing schedules, international shipping, customs processing and freight delays.
4.2 Pre-orders
A pre-order allows customers to purchase a product before it becomes available for dispatch.
Estimated dispatch dates for pre-order products are displayed on the relevant product page at the time of purchase and are provided as estimates only.
While Bambini will use reasonable endeavours to meet estimated dispatch dates, delays may occur due to circumstances outside our reasonable control, including manufacturing schedules, international shipping, customs processing and freight delays.
4.3 Shipment Allocation
Once a back-order or pre-order has been accepted, the product is allocated against an incoming shipment.
Shipment allocation reserves the customer's place within that shipment but does not guarantee a specific dispatch date.
4.4 Dispatch Updates
Bambini will use reasonable endeavours to keep customers informed of significant changes affecting estimated dispatch dates.
Once an order is ready for dispatch, Bambini will provide dispatch confirmation together with tracking information where available.
4.5 Cancellation Prior to Dispatch
Customers may request cancellation of a back-order or pre-order at any time prior to dispatch.
Approved cancellations are subject to Clause 5 (Order Changes & Cancellations - Pre-Dispatch) and Clause 6 (Order Returns & Refunds - Unopened).
Once an order has been dispatched, the Returns & Refunds provisions in Clause 6 apply.
5. Order Changes & Cancellations - Pre-Dispatch
5.1 Australian Consumer Law
Nothing in this Clause excludes, restricts or modifies any rights or remedies available to a Customer under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
5.2 Order Confirmation
Once an order has been accepted, Bambini will issue an Order Confirmation to the email address provided by the customer.
Customers are responsible for reviewing their Order Confirmation and notifying Bambini as soon as reasonably practicable if any details are incorrect.
The Order Confirmation forms the definitive record of the Products purchased and any promotional pricing, bundled offers, complimentary products or other promotional benefits applicable to the Order.
5.3 Order Changes
Customers may request changes to an order prior to dispatch.
While Bambini will use reasonable endeavours to accommodate requested changes, changes cannot be guaranteed once an order has entered processing, has been allocated to stock or has been dispatched.
No requested Order change is effective unless approved and confirmed in writing by Bambini.
Order changes may affect pricing, promotional eligibility, estimated dispatch dates or product availability.
Approved Order changes may also result in reasonable costs or deductions being payable in accordance with Clause 5.11 where additional administrative, operational or inventory allocation costs are incurred.
Bambini reserves the right to decline any requested Order change where the requested change would materially affect inventory allocation, operational requirements or the integrity of a Promotional Offer.
5.4 Product, Colour & Model Changes
Requests to change the Product, colour, model or configuration of an Order are treated as Order Changes and are subject to Clause 5.3.
Approval of such requests is at Bambini's discretion and may result in changes to pricing, promotional eligibility or estimated dispatch timeframes.
Any approved Product change constitutes a new Product selection for the purposes of promotional eligibility.
5.5 Delivery Address Changes
Customers are responsible for ensuring their delivery address is accurate at the time an order is placed.
Requests to change the delivery address of an Order are treated as Order Changes and are subject to Clause 5.3.
Bambini will use reasonable endeavours to accommodate requested delivery address changes prior to dispatch. Once an order has been dispatched, Bambini cannot guarantee that the delivery address can be amended.
Any additional freight, redirection or storage charges resulting from an address change request are the responsibility of the Customer unless otherwise agreed by Bambini.
5.6 Promotional Offers, Bundle Pricing & Order Reconfiguration
Products purchased as part of a promotional offer, bundle or package are supplied on the basis of the complete offer selected at the time of purchase.
If a customer requests to remove, substitute or withdraw part of a promotional offer, bundle or Qualifying Product prior to dispatch, Bambini may recalculate the order using Bambini's current selling price for the remaining products and remove any promotional discounts, complimentary items or bundled pricing that no longer apply.
No requested Order reconfiguration is effective unless approved and confirmed in writing by Bambini.
Where a complimentary product or promotional gift has already been supplied, it will be dealt with in accordance with Clause 9.5.
Where an approved Order reconfiguration results in the cancellation or removal of Products from an Order, any applicable reasonable costs or deductions permitted under Clause 5.11 may also apply.
5.7 Promotional Availability
Promotional Offers are available only while advertised and subject to stock availability unless expressly stated otherwise. Bambini reserves the right to amend, substitute or withdraw Promotional Offers for future Orders at any time. Promotional Offers cannot be applied retrospectively to Orders already accepted unless Bambini expressly agrees otherwise.
Eligibility for any Promotional Offer is determined by the applicable promotional terms and, where relevant, the Customer's Order Confirmation.
5.8 Customer Cancellations
Customers may request cancellation of an Order at any time prior to Dispatch.
Cancellation requests are not effective unless confirmed in writing by Bambini.
Bambini will consider cancellation requests acting reasonably, having regard to the status of the Order, inventory allocation, operational requirements and any applicable Promotional Offer.
The commencement of a new Promotional Offer, or Bambini's decision not to apply a Promotional Offer retrospectively to an existing Order, does not of itself provide grounds for cancellation or require Bambini to approve a cancellation request.
Once an Order has been Dispatched, cancellations are no longer available and the Returns & Refunds provisions contained in Clause 6 apply.
Where a cancellation is approved, any refund will be processed using the original payment method wherever reasonably practicable, less any applicable deductions permitted under Clauses 5.11 (Order Amendment & Cancellation Costs) and 5.12 (Payment Plan Orders).
5.9 Pricing Changes After Purchase
Once an order has been accepted, the purchase price is fixed.
Customers are not entitled to refunds, credits, discounts or order amendments because a product's price subsequently increases or decreases, a promotional campaign commences or concludes, or a different offer becomes available after the order has been placed.
The commencement, conclusion or availability of a Promotional Offer after an Order has been accepted does not, of itself, provide a Customer with a right to cancel the Order. Any request to cancel an Order remains subject to Clause 5.8.
5.10 Bambini Cancellations
Bambini reserves the right to cancel all or part of an order where reasonably necessary or appropriate, including (but not limited to) where a product is unavailable, a pricing or product description error has occurred, payment cannot be successfully processed, fraudulent or unauthorised activity is suspected, a discount code has been used contrary to its published terms, or the order has otherwise been placed in breach of these Terms & Conditions.
Where Bambini cancels an order, any applicable refund will be processed to the original payment method unless otherwise agreed.
5.11 Order Amendment & Cancellation Costs
Where Bambini approves the cancellation, amendment or reconfiguration of an Order prior to Dispatch, Bambini may deduct the reasonable costs actually incurred in accepting, processing, preparing, amending or cancelling the Order
before calculating any refund or any additional amount payable by the Customer.
Such costs may include, where applicable:
- non-refundable payment processing, merchant, gateway or transaction fees of up to 10% of the Order value;
- reasonable administrative and operational costs incurred in processing, amending, reconfiguring or cancelling the Order;
- reasonable inventory allocation or stock reservation costs incurred before the amendment, reconfiguration or cancellation.
The reasonable costs incurred may vary depending on the nature of the Order, including whether the Order was placed through the Bambini Website, Bambini Sydney Showroom, a Baby Expo or another promotional event.
Any applicable deductions will be deducted from the approved refund before payment is processed.
5.12 Payment Plan Orders
Where an Order has been purchased using an approved Bambini Payment Plan or layby arrangement, any approved Order cancellation remains subject to this Clause together with the Payment Plan provisions contained in Clause 2.4.
Customers acknowledge that Payment Plan Orders involve additional administration, payment processing and stock allocation over an extended period.
Where an approved Order cancellation gives rise to a refund, Bambini may deduct any non-refundable amount payable under the Payment Plan provisions contained in Clause 2.4 before calculating any refund.
Any applicable deductions will be deducted from the approved refund before payment is processed.
6. Order Returns & Refunds
6.1 Scope of this Returns Policy
The Change of Mind Returns provisions in this Clause apply only to eligible unused and Unopened Products, except where Bambini expressly agrees in writing under Clause 6.2 to accept an opened or used Product as a discretionary change-of-mind return.
These provisions do not apply where a Product has been opened, assembled or used and the Customer subsequently reports a fault, damage, performance issue or other warranty concern.
Where a Customer believes a Product has developed a Manufacturing Defect or otherwise fails to meet a consumer guarantee under the Australian Consumer Law, the matter will be assessed under Clause 7 (Warranty, Remedies & Discretionary Resolutions) and the Australian Consumer Law.
6.2 Change of Mind Returns
Subject to this Clause, Bambini accepts change-of-mind returns only where all of the following conditions are satisfied:
- The return is requested within seven (7) days of delivery.
- The Product remains Unopened and unassembled, in its original, undamaged packaging and in like-new condition.
- The Product has not been assembled, used, modified or damaged.
- All accessories, documentation and components originally supplied with the Product are returned in their original condition, and any complimentary products or promotional gifts are dealt with in accordance with Clause 9.5.
- The return has been authorised by Bambini in accordance with Clause 6.4.
- The Product otherwise satisfies all applicable requirements of this Clause.
Unless expressly varied by Clause 6.10 (Extended Promotional Returns), the seven (7) day return period applies to all change-of-mind returns.
If Bambini, in its sole discretion, expressly agrees in writing to accept an opened or used Product as a change-of-mind return, that return remains subject to Clauses 6.6 to 6.8.
6.3 Products Not Eligible for Change of Mind Returns
Unless otherwise required by the Australian Consumer Law, change-of-mind returns are not accepted for:
- Products that have been opened, assembled or used, except where Bambini has expressly agreed in writing to accept the Product under Clause 6.2.
- Custom-made, personalised or special-order Products.
- Clearance, outlet, display or damaged-box Products.
- Hygiene Products, including mattresses and bedding.
- Individual accessories or spare parts.
- Products purchased as part of a bundle, unless all Products forming part of that bundle are returned together or Bambini otherwise agrees in writing.
- Products returned solely for the purpose of changing colour, model or configuration, or obtaining the benefit of a subsequent price reduction, sale or promotional offer.
6.4 Return Authorisation
All returns require prior written authorisation from Bambini.
Before returning a Product, the Customer must contact Bambini and provide any information reasonably requested to review the return request. This may include proof of purchase, photographs, videos or other evidence demonstrating that the Product satisfies the applicable return conditions.
Failure to provide requested information may delay the review of the return request or result in the request being declined.
Products returned without prior authorisation may be refused and returned to the Customer at the Customer’s expense.
A Return Authorisation expires fourteen (14) days after being issued unless otherwise agreed by Bambini in writing. If the Product is not dispatched within that period, the Return Authorisation may be cancelled and the Customer may be required to submit a new return request.
6.5 Return Shipping
Unless otherwise required by law, the Customer is responsible for all costs associated with returning an authorised change-of-mind return.
Original outbound shipping charges are non-refundable.
Where complimentary outbound shipping was provided with the original Order, Bambini may deduct the actual outbound shipping cost incurred from any approved refund.
The Customer is responsible for ensuring the Product is appropriately packaged and protected during return transit.
Where return transit is arranged by the Customer, the Product remains at the Customer’s risk until received by Bambini. This does not apply to the extent that any loss or damage is caused by Bambini or a return carrier arranged by Bambini.
6.6 Return Inspection & Refunds
All returned Products, including any opened or used Product that Bambini has agreed to accept for return, are subject to inspection upon receipt by Bambini.
Authorisation to return a Product, including Bambini arranging or accepting collection of the Product, does not constitute final approval of the return, a refund, replacement, credit or other remedy.
Unless Bambini expressly confirms otherwise in writing, no refund will be approved or processed until the Product has been received and inspected and Bambini has confirmed the applicable outcome and final approved refund amount.
In conducting its inspection, Bambini may have regard to:
- the reported reason for return;
- the Product’s condition;
- evidence of assembly, use, damage or maintenance;
- the condition and adequacy of the return packaging;
- included components, accessories, documentation and promotional items; and
- the applicable return conditions and Australian Consumer Law requirements.
Any complimentary product or promotional gift associated with a returned Qualifying Product will be dealt with in accordance with Clause 9.5.
Where a returned Product does not satisfy the applicable return conditions and the Customer is not otherwise entitled to a remedy under the Australian Consumer Law, Bambini may, acting reasonably:
- refuse the return;
- return the Product to the Customer at the Customer’s expense; or
- where reasonably appropriate, offer an alternative commercial resolution at Bambini’s discretion.
Following inspection, Bambini will confirm whether the return has been approved and the final approved refund amount, including any applicable deductions permitted under this Clause 6.
Approved refunds will be processed using the original payment method wherever reasonably practicable within fourteen (14) business days after the Product has been inspected and the refund amount approved.
Nothing in this Clause excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
6.7 Restocking Fees
Unless otherwise required by law, approved change-of-mind returns are subject to a restocking fee equal to fifteen percent (15%) of the original purchase price paid for the returned Product.
The restocking fee is charged to recover the administrative, return inspection, inventory handling and payment processing costs incurred by Bambini in accepting and processing a change-of-mind return.
The applicable restocking fee will be deducted from any approved refund.
This Clause does not apply to any refund or remedy required under the Australian Consumer Law.
6.8 Repackaging, Restoration & Reduction in Value
Where Bambini has agreed to accept an opened or used Product as a discretionary change-of-mind return, or where a returned Product is not received in the authorised condition, Bambini may deduct from any approved refund a reasonable amount reflecting:
- the reasonable cost of cleaning, repairing, relabelling, replacing packaging, reboxing, replacing missing or damaged components or accessories, or otherwise restoring the Product to a saleable condition; and
- any actual reduction in the Product’s value that remains after reasonable restoration, including where the Product can no longer be sold as new.
A deduction may also reflect damage occurring because the Product was not adequately packaged or protected for return transit.
Any deduction will be determined following inspection, must be reasonably proportionate to the applicable cost or reduction in value and must not exceed the amount otherwise refundable.
Bambini will advise the Customer of the reason for and amount of any deduction before processing the refund.
The deductions permitted under this Clause may apply in addition to the restocking fee under Clause 6.7. However, Bambini will not recover the same cost or reduction in value more than once.
Nothing in this Clause applies to reduce any refund required under the Australian Consumer Law.
6.9 Refused Deliveries
Where a Customer refuses delivery of an Order that is not subject to a valid claim under the Australian Consumer Law, the refusal will be treated as a change-of-mind return.
The Order will remain subject to this Returns Policy, including:
- outbound and return shipping costs under Clause 6.5;
- any applicable restocking fee under Clause 6.7; and
- any applicable deductions under Clause 6.8.
6.10 Extended Promotional Returns
From time to time, Bambini may offer an extended six (6) month return period as a promotional benefit for selected Bambini Prams and Strollers.
An Extended Promotional Return applies only where all of the following conditions are met:
- The promotion was active at the time the Order was placed.
- Extended Promotional Return eligibility is expressly recorded on the Customer’s Order Confirmation.
- The Product is identified as eligible under the applicable promotion.
- The purchase was made directly through the Bambini Website or Bambini Sydney Showroom.
- The Product continues to satisfy the conditions set out in Clause 6.2, except that the return period is extended in accordance with this Clause.
Where eligible, a Customer may request a return within six (6) months of delivery.
Extended Promotional Returns do not apply to:
- Purchases made through authorised retailers.
- Purchases made at Baby Expos.
- Clearance, outlet, display or damaged-box Products.
- Bundle or promotional purchases unless the promotion expressly states that Extended Promotional Returns apply.
- Pre-order or back-order Products unless expressly stated.
- Products that are not expressly advertised as eligible for the promotion.
Extended Promotional Return eligibility cannot be inferred from advertising, previous promotions, prior purchases or verbal representations and exists only where expressly recorded on the Customer’s Order Confirmation.
If Extended Promotional Return eligibility is not recorded on the Customer’s Order Confirmation, the standard seven (7) day change-of-mind return period in Clause 6.2 applies.
Except where expressly varied by this Clause, all other provisions of this Returns Policy continue to apply.
Extended Promotional Returns:
- Are offered solely as a limited-time promotional benefit.
- May be amended, suspended or withdrawn for future purchases at any time.
- Apply only to eligible Orders placed during the applicable promotional period.
- Cannot be applied retrospectively to Orders placed before the promotion commenced.
- Are determined solely by the eligibility recorded on the Customer’s Order Confirmation.
6.11 Payment Plan Orders
Where an Order has been purchased using an approved Bambini Payment Plan or layby arrangement, any approved change-of-mind return remains subject to this Clause together with the Payment Plan provisions contained in Clause 2.4.
Customers acknowledge that Payment Plan Orders involve additional administration, payment processing and stock allocation over an extended period.
Where a change-of-mind return is approved, Bambini may deduct:
- any non-refundable amount payable under the Payment Plan Terms in Clause 2.4;
- any applicable restocking fee permitted under Clause 6.7; and
- any applicable deduction permitted under Clause 6.8,
before calculating the final approved refund amount.
6.12 Legacy Returns Policy
This Clause applies only to Orders placed before 8 July 2026 that qualified for Bambini’s previous Extended Returns Policy.
Orders placed on or after 8 July 2026 are governed exclusively by this Clause 6.
Where applicable, eligible Orders placed before 8 July 2026 may continue to receive the benefit of the previous Extended Returns Policy in accordance with the terms that applied at the time the Order was placed.
Eligibility for any legacy promotional return remains subject to the Customer’s Order Confirmation and the terms in effect at the time of purchase.
6.13 Related Policies
This Returns Policy should be read together with Bambini’s:
- Shipping Policy;
- Warranty Policy; and
- any other policy expressly incorporated into these Terms & Conditions.
Where an inconsistency exists between this Returns Policy and the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.
7. Warranty, Remedies & Discretionary Resolutions
7.1 Scope of Warranty
Bambini is committed to quality and craftsmanship.
Bambini warrants that its Products will be free from Manufacturing Defects during the applicable Warranty Period when the Product has been assembled, used and maintained in accordance with the Product instructions, User Manual and technical specifications.
The Bambini Warranty covers Manufacturing Defects only. A Product being within its applicable Warranty Period does not, by itself, mean that a reported issue is covered by the Bambini Warranty. All reported issues are subject to assessment to determine whether a Manufacturing Defect exists and whether the issue is covered under this Warranty.
Where the cause of an issue cannot reasonably be determined or a Manufacturing Defect cannot be confirmed, Bambini may consider a Discretionary Resolution in accordance with Clause 7.9.
Rights and remedies available under Australian Consumer Law apply in addition to the Bambini Warranty.
Products purchased under a previous Bambini warranty offering remain subject to the Warranty Period and Extended Warranty eligibility applicable to that Product at the original date of purchase. Historical Warranty Periods are available on Bambini’s Legacy Warranty page.
7.2 What Is Not Covered
Unless otherwise required by Australian Consumer Law, the Bambini Warranty does not cover normal wear and tear, cosmetic wear, accidental damage, misuse, neglect, incorrect assembly, inadequate maintenance, failure to perform routine maintenance, improper storage, modification, unauthorised repairs, commercial or hire use, or damage caused by use outside the Product’s intended purpose.
Bambini Products are designed for normal outdoor use and should be routinely inspected, cleaned and maintained in accordance with the Product instructions and User Manual. As a general guide, moving parts should be cleaned, inspected and maintained approximately every three (3) months, or more frequently where the Product is used regularly or in harsh environments.
The Bambini Warranty does not cover damage resulting from environmental exposure or inadequate maintenance, including prolonged outdoor storage, storage in damp or poorly ventilated environments, excessive moisture, salt air, sand, beach environments, excessive heat, prolonged UV exposure, mould, corrosion, or failure to clean and maintain the Product in accordance with the Product instructions and User Manual.
The Bambini Warranty does not cover gradual deterioration, material fatigue or failure of individual components arising through normal use over time where, following assessment by Bambini, the condition is consistent with the Product’s age, overall condition, ordinary use or expected service life rather than a Manufacturing Defect.
The failure of an individual component after extended use does not, of itself, indicate the presence of a Manufacturing Defect.
7.3 Warranty Periods
The following standard Warranty Periods apply from the original date of purchase unless otherwise stated.
Bambini Prams and Strollers
Standard warranty: Two (2) years.
Eligible Products may be extended to four (4) years where the Product is registered with Bambini within three (3) months of delivery.
Bambini Nursery Collections
Standard warranty: One (1) year.
Bambini Pram Accessories and Spares
Standard warranty: One (1) year.
Bambini Baby Textiles
Standard warranty: One (1) year.
Complimentary Bambini Promotional Products
Standard warranty: One (1) year.
Complimentary Bambini Promotional Products are not eligible for Extended Warranty registration unless otherwise expressly stated.
Legacy, Clearance or Ex-Demo Products
Standard warranty: One (1) year.
Where a newer or alternative Product model is supplied to fulfil an order originally placed for a Legacy, Clearance or Ex-Demo Product, the Warranty Period applicable to the original order will continue to apply. The supply of a newer or alternative model does not extend or alter the Warranty Period applicable to the original purchase.
Car Seats and Car Capsules
Manufacturer’s warranty: As provided by the original manufacturer.
Other Third-Party Products
Manufacturer’s warranty: As provided by the original manufacturer or supplier.
7.4 Warranty Enquiries
Customers who believe their Product may have a Manufacturing Defect should submit a Warranty Enquiry to Bambini by completing the online Warranty Enquiry Form.
Customers must provide proof of purchase, a description of the reported issue, clear photographs and/or videos where reasonably capable of demonstrating the issue, and any Product serial number, batch information or other information reasonably required by Bambini to assess the Warranty Enquiry.
Customers should notify Bambini of any suspected Manufacturing Defect as soon as reasonably practicable after the issue becomes apparent.
If a Customer believes a Product arrived with a Manufacturing Defect that was present at the time of delivery, Bambini requests that the issue be reported within fourteen (14) days of delivery to assist with prompt assessment.
Failure to notify Bambini within fourteen (14) days does not automatically affect the Customer’s rights under Australian Consumer Law or the applicable Warranty Period.
7.5 Warranty Assessment
All Warranty Enquiries are subject to assessment by Bambini or its authorised service representatives.
The assessment process may include the following stages. Depending on the nature of the Warranty Enquiry, some stages may not be required or may occur in a different order where reasonably necessary.
Step 1 – Review
Bambini will review the Warranty Enquiry and the information and evidence provided by the Customer.
Many enquiries may be resolved at this stage without requiring the Product to be returned.
Step 2 – Assessment & Troubleshooting
Where appropriate, Bambini may request additional information, photographs or videos and may ask the Customer to complete reasonable troubleshooting, adjustments or diagnostic procedures to assist in identifying the issue and determining whether a Manufacturing Defect exists.
Assessment and troubleshooting may continue as further information or evidence becomes available.
Step 3 – Further Assessment
Where the cause of an issue cannot reasonably be determined from the information available, Bambini may request inspection of the Product or affected component, return of the Product or component for assessment, or other reasonable steps necessary to determine the nature and cause of the reported issue.
Customers must make the Product or affected component reasonably available for assessment. Bambini Prams and Strollers are designed to fold and separate into transportable components and can generally be returned by courier when appropriately packaged. Unless otherwise agreed in writing or required by Australian Consumer Law, the Customer is responsible for delivering the Product or arranging its return to Bambini or its authorised service representative.
Where a Manufacturing Defect or other failure entitling the Customer to a remedy under Australian Consumer Law is confirmed, Bambini will arrange or reimburse reasonable return costs in accordance with Clause 7.7.
Effect of Return Authorisation
Authorisation to return a Product, including collection or receipt of the Product by Bambini, means only that the Product has been accepted for Physical Assessment. It does not constitute final approval of a refund, replacement, credit or other remedy.
Unless Bambini expressly confirms a final remedy in writing, the appropriate outcome will be determined following Physical Assessment in accordance with Step 4, these Terms & Conditions and Australian Consumer Law.
Step 4 – Assessment Outcome
Following assessment, the Warranty Enquiry will proceed to the appropriate pathway in accordance with these Terms & Conditions and Australian Consumer Law.
Where a Manufacturing Defect is confirmed, the matter will proceed in accordance with Clause 7.8.
Where a reported issue is not covered by the Bambini Warranty, or where the cause cannot reasonably be determined or a Manufacturing Defect cannot be confirmed, Bambini may consider a Discretionary Resolution in accordance with Clause 7.9.
Customers agree to provide reasonable cooperation throughout the assessment process, including providing requested information, photographs, videos, access to the Product, or completing reasonable troubleshooting or diagnostic steps where requested by Bambini.
In assessing a Warranty Enquiry, Bambini may consider all relevant circumstances, including:
the age of the Product;
the nature of the reported issue;
the Product’s overall condition;
the completeness of any Product, components or accessories returned;
evidence of use, damage or modification;
maintenance history where available; and
whether the reported issue is consistent with a Manufacturing Defect, normal wear and tear, material fatigue, inadequate maintenance or deterioration arising through ordinary use.
Where a Product is returned for assessment and no Manufacturing Defect or other failure to comply with a consumer guarantee is identified, Bambini may require the Customer to pay reasonable collection, inspection or return freight costs where permitted by law.
Where Bambini arranges collection or proposes to charge inspection costs, the Customer will be provided with a reasonable estimate of any costs that may become payable before the Product is collected or inspected.
7.6 Retailers
Authorised Retailers may assist with collecting information or facilitating communication.
Claims made under the Bambini Warranty are administered by Bambini or its authorised service representatives unless otherwise agreed.
Where a Product was purchased from an Authorised Retailer, nothing in this Clause limits any rights or remedies the Customer may have against that retailer under Australian Consumer Law or requires the Customer to deal exclusively with Bambini.
7.7 Freight for Warranty Enquiries
Responsibility for freight, collection and transportation costs associated with a Warranty Enquiry will be determined in accordance with Australian Consumer Law.
Where required by Australian Consumer Law, Bambini will arrange collection or meet the reasonable transportation costs of making the Product available for assessment.
Where a Manufacturing Defect or other failure entitling the Customer to a remedy under Australian Consumer Law is confirmed, Bambini will arrange or reimburse reasonable freight costs associated with the assessment and provision of the applicable remedy, having regard to the nature of the Product, the remedy and the Customer’s location.
7.8 Warranty Remedies
Where a Manufacturing Defect is confirmed during the applicable Warranty Period, Bambini will provide an appropriate Warranty Remedy in accordance with these Terms & Conditions.
Where a Product fails to comply with a consumer guarantee, Bambini will provide the remedy required under Australian Consumer Law, whether or not the applicable Bambini Warranty Period has expired.
Depending on the nature of the issue and the Customer’s rights under Australian Consumer Law, the remedy may include:
repair of the Product;
replacement of the affected component;
replacement of the Product;
a refund; or
another remedy required under Australian Consumer Law.
Where appropriate and consistent with Australian Consumer Law, Bambini may repair a Product or replace an individual component rather than replacing the entire Product.
Where Australian Consumer Law gives the Customer the right to choose the remedy, Bambini will provide the remedy selected by the Customer.
Except where required by Australian Consumer Law, Bambini is not obliged to provide financial compensation in connection with a Warranty Enquiry, warranty assessment or remedy provided under this Clause.
7.9 Discretionary Resolutions
Where, following assessment, Bambini has not established that a reported issue is covered by the Bambini Warranty or otherwise gives rise to a remedy required under Australian Consumer Law, Bambini may nevertheless, at its discretion, offer a Discretionary Resolution as a gesture of goodwill.
Discretionary Resolutions are not standard entitlements and should not be expected or inferred from previous resolutions offered by Bambini.
A Discretionary Resolution may include troubleshooting support, repair, replacement of an individual component, replacement of the Product, a full or partial refund, or another appropriate resolution determined by Bambini having regard to the reported issue, the Product and the circumstances of the enquiry.
Where assessment does not identify a Manufacturing Defect or other failure requiring a remedy under Australian Consumer Law, Bambini is not required to provide a refund. If the Customer declines return of the Product and Bambini agrees, at its discretion, to provide a refund, the refund may be reasonably reduced to reflect the Product’s use, age, condition and resulting reduction in value.
The provision of a Discretionary Resolution does not constitute an admission that a Manufacturing Defect exists, that the Product fails to comply with a consumer guarantee, or that Bambini is otherwise legally liable for the reported issue.
Nothing in this Clause limits any rights or remedies available to the Customer under Australian Consumer Law.
7.10 Replacement Parts
Where a reported issue affects an individual replaceable part, component, accessory, fabric item, wheel, canopy, frame section or other replaceable element, Bambini may determine that repair or replacement of that component is the appropriate Warranty Remedy, having regard to the nature of the issue and the requirements of Australian Consumer Law.
Replacement parts supplied by Bambini may consist of new or refurbished components of equivalent quality and performance.
Replacement of an individual part does not automatically entitle the Customer to replacement of the entire Product unless required by Australian Consumer Law.
7.11 Replacement Parts Warranty
Replacement parts, spare parts and individual components purchased separately are covered by a Warranty Period of one (1) year from the date of purchase.
Replacement parts, spare parts and individual components supplied as a Warranty Remedy or as part of a Discretionary Resolution are covered by a Warranty Period of one (1) year from the date they are supplied to the Customer.
The replacement part warranty applies only to the replacement part supplied and does not apply to the original Product as a whole.
The supply of a replacement part, spare part or individual component does not restart or extend the Warranty Period applicable to the original Product unless otherwise required by Australian Consumer Law.
Rights and remedies available under Australian Consumer Law apply in addition to the replacement part warranty.
7.12 Extended Warranty
Extended Warranty is available only for eligible Bambini Products and applies only where the Product has been registered with Bambini within the required registration period.
Extended Warranty does not change the scope of warranty coverage. It extends the applicable Warranty Period for eligible Products only.
Products that are not registered, are not eligible for Extended Warranty, or do not meet the registration requirements remain subject to the standard Warranty Period.
7.13 Third-Party Products
Car seats, car capsules and other Third-Party Products may also be covered by the warranty terms of the original manufacturer or supplier.
Where a Warranty Enquiry relates to a Third-Party Product, Bambini may assist the Customer or facilitate a claim under the applicable manufacturer’s warranty.
Where Bambini supplied the Third-Party Product to the Customer, this does not require the Customer to pursue the original manufacturer instead of Bambini or limit any rights or remedies available against Bambini under Australian Consumer Law.
7.14 Overseas Products
The Bambini Warranty is administered within Australia.
To enable Bambini to assess, repair or otherwise administer a Warranty Enquiry, the Product or affected component must be made available to Bambini within Australia unless otherwise agreed in writing or required by law.
Customers whose Products are located outside Australia must arrange, at their own cost and risk, for the Product or affected component to be returned to Australia unless otherwise agreed by Bambini in writing or required by law.
Nothing in this Clause limits any rights or remedies available under Australian Consumer Law.
7.15 Travel & Transit Damage
The Bambini Warranty does not cover damage caused during transportation by airlines, airports, baggage handlers, freight carriers or other third-party transport providers after delivery of the Product to the Customer.
Customers should inspect their Product following travel and pursue any available claim directly with the relevant airline, carrier or travel insurer where damage has occurred during transit.
This Clause does not limit any responsibility Bambini may have under Australian Consumer Law or another applicable law.
7.16 Promotional Products
Where a Bambini Product is supplied free of charge as part of a promotional offer, giveaway, competition, prize draw or similar promotion, it is covered by the Bambini Warranty for the Warranty Period expressly stated in the applicable promotion or recorded on the Customer’s Order Confirmation.
Unless otherwise stated, complimentary Bambini Promotional Products are covered by a Warranty Period of one (1) year and are not eligible for Extended Warranty registration.
Where a complimentary Promotional Product is a Third-Party Product, any applicable warranty is subject to the terms of the original manufacturer or supplier, together with any rights or remedies available under Australian Consumer Law.
For the purpose of determining the applicable Warranty Period, the date the Promotional Product is supplied to the recipient will be treated as the original date of purchase unless otherwise stated by Bambini.
7.17 Relationship with Returns
Warranty Enquiries are assessed separately from Change of Mind Returns.
If a Customer believes their Product has developed a Manufacturing Defect or otherwise fails to comply with a consumer guarantee, the matter will be assessed under this Clause and Australian Consumer Law, not under the Change of Mind Returns provisions in Clause 6.
7.18 Genuine Bambini Replacement Parts
Bambini recommends the use of genuine Bambini replacement parts.
Damage arising from the installation or use of non-genuine or incompatible components may not be covered by the Bambini Warranty.
Nothing in this Clause limits any rights or remedies available under Australian Consumer Law.
8. Product Specifications, Availability & Manufacturing Variations
8.1 Product Information
Bambini uses reasonable endeavours to ensure that product descriptions, specifications, dimensions, photographs, videos and other information published on its Website and other sales channels are accurate at the time of publication.
However, product information may occasionally contain typographical errors, inaccuracies or omissions.
Bambini reserves the right to correct any errors, update product information and amend specifications at any time without prior notice.
8.2 Product Images, Colours & Manufacturing Variations
Product photographs, videos and other images are provided for illustrative purposes only.
Customers acknowledge that product colours displayed on electronic devices may vary depending on individual screen settings, device calibration and lighting conditions. Bambini cannot guarantee that colours displayed on a customer's device will exactly match the finished product.
Minor variations between production batches, including differences in fabric shade, texture, grain, stitching, trim, hardware, branding, logos, zippers, wheels or other cosmetic finishes that do not affect the intended function, safety or quality of the product do not constitute a manufacturing defect.
8.3 Product Availability
All products are offered subject to availability.
Occasionally a product may become unavailable after an order has been placed due to circumstances outside Bambini's reasonable control.
Where this occurs, Bambini may offer an alternative product, an updated estimated dispatch date, a partial cancellation, a full refund or another mutually agreed solution.
8.4 Product Improvements
Bambini continually reviews and improves its products.
From time to time, product specifications, materials, colours, packaging, included accessories, manufacturing processes or design features may change without notice.
Such improvements are part of Bambini's ongoing product development and do not indicate that earlier versions are defective.
Product improvements, design updates or model revisions do not create an obligation for Bambini to upgrade, replace or modify products previously purchased, nor do they in themselves constitute a manufacturing defect or entitle a customer to a warranty enquiry, replacement product or other remedy.
8.5 Product Compatibility
Customers are responsible for ensuring that Products are suitable for their intended purpose, lifestyle and individual requirements before placing an Order. Customers should familiarise themselves with the Product's features, dimensions, configurations, inclusions and compatibility before purchasing.
Where compatibility information is provided by Bambini, it is based on information available at the time of publication and may change as products evolve or third-party manufacturers update their own products.
8.6 Product Measurements & Dimensions
Bambini uses reasonable endeavours to ensure that published product dimensions, weights, capacities and other measurements are accurate at the time of publication.
Unless otherwise stated, all measurements are approximate and may vary slightly due to manufacturing tolerances, production methods or the method of measurement.
Minor variations in published measurements do not constitute a manufacturing defect or entitle a customer to a warranty enquiry, replacement product or other remedy unless otherwise required by Australian Consumer Law.
9. Promotions, Gift Cards & Discount Codes
9.1 Promotional Offers
From time to time, Bambini may offer promotional pricing, bundled offers, complimentary products, discounts or other promotional incentives.
Unless expressly stated otherwise, promotional offers are available only for the advertised promotional period and cannot be applied retrospectively to orders placed before or after the promotion.
Promotional offers are available while stocks last and may be withdrawn, amended or extended by Bambini at any time unless a customer's order has already been accepted.
9.2 Promotional Eligibility
Promotional offers are subject to the specific terms published for that promotion.
Unless expressly stated otherwise, promotional offers cannot be combined with other discounts, promotions or offers.
Where a customer no longer satisfies the conditions of a promotional offer due to an order amendment, cancellation or removal of a qualifying product, Bambini may recalculate the order in accordance with Clause 5 (Order Changes & Cancellations).
9.3 Discount Codes
Discount codes must be entered at the time of checkout or disclosed to Bambini before payment is completed.
Discount codes cannot be applied retrospectively once an order has been accepted.
Discount codes must be used in accordance with their published conditions and Bambini reserves the right to refuse, cancel or recover any benefit obtained through the incorrect, unauthorised or fraudulent use of a discount code.
9.4 Gift Cards
Bambini Gift Cards may be redeemed only in accordance with their published terms and conditions.
Gift Cards are not redeemable for cash, cannot be exchanged for cash and are non-refundable except where required by Australian Consumer Law.
Bambini Gift Cards and Store Credits cannot be redeemed towards car seats or car capsules.
Where a purchase made using a Gift Card is refunded, Bambini may refund the amount by reissuing credit to a Gift Card or another payment method at Bambini's discretion, unless otherwise required by Australian Consumer Law.
9.5 Complimentary Products & Promotional Gifts
A Promotional Item supplied with a Qualifying Product is supplied at no additional charge and cannot be exchanged for cash, credit, substitution or an alternative product unless otherwise required by Australian Consumer Law.
Where a Promotional Item has already been supplied and the Qualifying Product is cancelled, removed from an Order or accepted for a change-of-mind or other discretionary return, the Promotional Item must also be returned in accordance with the applicable return conditions.
If the Promotional Item is not returned in accordance with those conditions, Bambini may deduct from the approved refund the promotional value recorded by Bambini for that Promotional Item at the time the Order was placed.
Promotional Items may be subject to specific warranty conditions, including a different Warranty Period or Extended Warranty eligibility, as stated in the applicable Promotional Offer or Order Confirmation.
Nothing in this Clause applies to reduce any refund required under the Australian Consumer Law.
9.6 Sales Channels
Bambini sells products through a variety of sales channels, including its Website, showroom, Baby Expos and authorised retail partners.
Product pricing, promotional offers, bundled inclusions, product availability and other commercial terms may differ between sales channels. Promotions or pricing available through one sales channel may also be made available through another sales channel where Bambini expressly elects to do so.
10. Website Use & Intellectual Property
10.1 Website Use
Customers may access and use the Bambini Website for lawful personal and non-commercial purposes.
Customers must not use the Website in any manner that is unlawful, fraudulent, deceptive, or intended to interfere with the operation or security of the Website, Bambini's payment systems, or the rights of Bambini or any third party.
Bambini reserves the right to suspend or restrict access to the Website where reasonably necessary to protect the Website, its customers or its business.
10.2 Customer Accounts
Where customers create an account on the Bambini Website, they are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
Customers must notify Bambini promptly if they become aware of any unauthorised access to their account.
Bambini reserves the right to suspend or terminate customer accounts where reasonably necessary, including where these Terms & Conditions have been breached or fraudulent or unlawful activity is suspected.
10.3 Intellectual Property
Unless otherwise stated, all intellectual property rights in the Website and its contents, including text, photographs, videos, graphics, logos, trademarks, product names, designs, software and other materials, are owned by or licensed to Bambini.
Nothing in these Terms & Conditions grants any licence or right to use Bambini's intellectual property except as reasonably required to browse and use the Website for its intended purpose.
10.4 Copyright
All content published by Bambini is protected by Australian and international copyright laws.
Customers must not reproduce, distribute, modify, publish, commercially exploit or otherwise use any content from the Website without Bambini's prior written consent, except where permitted by law.
10.5 Trademarks
"Bambini", Bambini product names, feature names, technology names, logos, graphics and other brand identifiers are trademarks owned by or licensed to Bambini.
Customers must not use Bambini's trademarks without Bambini's prior written consent.
10.6 Website Availability
While Bambini uses reasonable endeavours to keep the Website available and current, uninterrupted access cannot be guaranteed.
The Website may be unavailable from time to time due to maintenance, upgrades, technical issues or circumstances outside Bambini's reasonable control.
10.7 Third-Party Links
The Website may contain links to third-party websites for customer convenience.
Bambini does not control and is not responsible for the content, availability, products, services or privacy practices of third-party websites.
Accessing third-party websites is at the customer's own risk.
10.8 User Content
Where customers submit reviews, photographs, videos, testimonials or other content to Bambini, customers warrant that they have the necessary rights to submit that content.
Customers grant Bambini a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, edit and display that content for marketing, customer service and business purposes unless otherwise agreed in writing.
Customers must not submit content that is unlawful, defamatory, misleading, infringing or otherwise inappropriate.
11. Privacy & Communications
11.1 Privacy
Bambini respects your privacy and is committed to handling personal information in accordance with applicable privacy laws.
The collection, use, storage and disclosure of personal information is governed by Bambini's Privacy Policy, which forms part of these Terms & Conditions and is available on the Bambini Website.
11.2 Collection of Information
Customers acknowledge that Bambini may collect personal information reasonably required to process orders, provide customer support, administer warranties, respond to enquiries, improve products and services, comply with legal obligations and otherwise operate its business.
Where required by law, Bambini will obtain the customer's consent before collecting or using personal information for other purposes.
11.3 Marketing Communications
Where a customer has subscribed to receive marketing communications or otherwise provided consent, Bambini may send information relating to products, promotions, events, educational content and other marketing communications by email, SMS or other electronic means.
Customers may unsubscribe from marketing communications at any time using the unsubscribe facility included within the communication or by contacting Bambini directly.
Unsubscribing from marketing communications does not prevent Bambini from sending communications relating to an existing order, warranty enquiry, product safety, recall, account administration or other non-marketing matters.
11.4 Electronic Communications
By placing an order or otherwise communicating with Bambini electronically, customers agree that Bambini may provide notices, updates, invoices, order confirmations, warranty communications and other information electronically, including by email or other electronic means.
Electronic communications satisfy any legal requirement that such communications be provided in writing unless otherwise required by law.
11.5 Product Safety & Recalls
Where Bambini reasonably believes it is necessary for customer safety, regulatory compliance or product administration, Bambini may contact customers regarding important product information, product safety notices, recalls, replacement programs or other safety-related matters.
Customers are responsible for ensuring that their contact details remain current to assist Bambini in providing important product-related communications.
11.6 Customer Feedback & Surveys
From time to time, Bambini may invite customers to participate in surveys, product reviews or feedback relating to their purchase or customer experience.
Participation is voluntary and any feedback provided may be used by Bambini to improve its products, services and customer experience.
11.7 Recording of Communications
To assist with quality assurance, staff training, dispute resolution and the administration of customer enquiries, Bambini may retain records of communications with customers, including emails, website enquiries, online chat conversations, photographs, videos and other information voluntarily provided to Bambini.
Where telephone calls are recorded, customers will be notified where required by applicable law.
12. General Legal Provisions
12.1 Limitation of Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
Subject to those rights, Bambini's liability is limited to the maximum extent permitted by law.
12.2 Events Outside Bambini's Control
Bambini will not be responsible for any delay or failure to perform its obligations where the delay or failure arises from circumstances beyond its reasonable control.
Such circumstances may include natural disasters, severe weather, industrial disputes, supplier delays, manufacturing interruptions, customs delays, freight disruptions, pandemics, government action, power failures, cyber incidents or other unforeseen events.
12.3 Changes to these Terms & Conditions
Bambini may amend these Terms & Conditions from time to time.
The version published on the Bambini Website at the time an Order is placed will apply to that Order unless otherwise required by law.
Changes to these Terms & Conditions do not apply retrospectively to completed purchases unless expressly stated.
12.4 Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect.
12.5 Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
12.6 Definitions
Words defined in this Clause have the same meaning wherever used in these Terms & Conditions unless the context otherwise requires.
Unless the context otherwise requires, the following definitions apply throughout these Terms & Conditions.
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.
Authorised Retailer means a retailer authorised by Bambini to sell Bambini Products.
Back-order means an Order placed for a Product that is temporarily out of stock but available for future dispatch.
Bambini means Bambini Prams Pty Ltd (ABN 84 628 952 205).
Business Day means a day other than a Saturday, Sunday or public holiday in New South Wales, Australia.
Customer means the person or entity purchasing, ordering or using a Product supplied by Bambini.
Delivery means the completion of delivery in accordance with Clause 3 (Shipping & Delivery).
Dispatch means the point at which an Order is collected by or handed to Bambini's nominated delivery provider for delivery to the Customer.
Gift Card means a gift card issued by Bambini that may be redeemed towards eligible purchases in accordance with its applicable terms.
Manufacturing Defect means a defect in the manufacture, materials or workmanship of a Product that becomes apparent under ordinary use and is attributable to the way the Product was manufactured or assembled. A Manufacturing Defect does not include Normal Wear and Tear, including material fatigue or the failure of individual components arising through ordinary use over time, accidental damage, misuse, neglect or any other exclusion described in Clause 7.
Normal Wear and Tear means the gradual deterioration of a Product or its components resulting from ordinary use over time, including cosmetic deterioration, material fatigue, and the failure of individual components due to age, repeated use or the Product reaching its expected service life. Normal Wear and Tear does not, of itself, constitute a Manufacturing Defect, even where such deterioration results in the failure or breakage of a component.
Order means a purchase of one or more Products that has been accepted by Bambini.
Order Confirmation means the order confirmation email, tax invoice or other written confirmation issued by Bambini at the time an Order is accepted, which records the Products purchased and any promotional benefits or eligibility applicable to that Order.
Payment Plan means any layby, instalment payment arrangement or other deferred payment arrangement approved by Bambini.
Pre-order means an Order placed for a Product before it becomes available for Dispatch.
Product means any pram, stroller, nursery product, accessory, spare part, textile or other goods supplied by Bambini.
Promotional Item means a complimentary Product, bonus item or promotional gift supplied as part of a Promotional Offer or with a Qualifying Product.
Promotional Offer means any promotional pricing, bundle, complimentary product, discount, gift, incentive or other promotional campaign offered by Bambini for a limited period or subject to specified conditions.
Qualifying Product means a Product that qualifies for a Promotional Offer or any other promotional benefit offered by Bambini, subject to the applicable promotional terms.
Return Authorisation means the written approval issued by Bambini permitting a Customer to return a Product in accordance with Clause 6.
Third-Party Product means a Product supplied by Bambini that is manufactured or warranted by another manufacturer or supplier.
Unopened means a Product that has not been opened, assembled, used or removed from its original protective packaging and remains in its original, undamaged packaging with no evidence of tampering, repackaging or use.
Warranty Period means the applicable warranty period set out in Clause 7 of these Terms & Conditions.
Website means the Bambini Website located at www.bambiniworld.com and any associated online sales channels operated by Bambini.
12.7 Interpretation
Headings are included for convenience only and do not affect the interpretation of these Terms & Conditions.
Unless the context otherwise requires, words importing the singular include the plural and words importing the plural include the singular.
References to a person include an individual, company, partnership, trust, government authority or other legal entity.
A reference to any legislation includes any amendment, replacement or re-enactment of that legislation and any subordinate legislation made under it.
A reference to a clause is a reference to a clause of these Terms & Conditions unless otherwise stated.
12.8 Entire Agreement
These Terms & Conditions, together with any policies expressly referred to within them, constitute the entire agreement between Bambini and the Customer in relation to the purchase of Products from Bambini and supersede any previous representations, understandings or agreements relating to that purchase.
Nothing in this clause excludes or limits any rights or remedies available under Australian Consumer Law.
12.9 No Waiver
The failure or delay by Bambini to exercise any right or remedy under these Terms & Conditions does not constitute a waiver of that right or remedy.
Any waiver must be made in writing and applies only to the specific matter for which it is given.
12.10 Survival
Any provision of these Terms & Conditions which by its nature is intended to survive cancellation, completion of an Order or termination of the relationship between Bambini and the Customer will continue to apply to the extent necessary.
12.11 Finalisation of Customer Enquiries
Bambini is committed to assessing all Customer enquiries fairly, reasonably and in accordance with these Terms & Conditions and Australian Consumer Law.
Where Bambini has completed its assessment of an enquiry, communicated its decision together with the reasons for that decision, and any applicable rights or remedies have been provided, Bambini may consider the matter finalised. Where Bambini considers an enquiry to be finalised, Bambini will clearly advise the Customer that its response constitutes Bambini's final position or final resolution in relation to that matter.
If a Customer believes they have new information or evidence that may materially affect Bambini's assessment, the Customer should clearly identify that new information or evidence when contacting Bambini. Bambini may review the matter further where reasonably appropriate.
Bambini is not obliged to repeatedly reconsider or reassess the same enquiry where no new relevant information or evidence has been provided.
Where an enquiry has been fully assessed, Bambini has notified the Customer that its response constitutes its final position or final resolution, and no new relevant information or evidence has been provided, Bambini may decline to enter into further correspondence regarding the same matter.
Nothing in this clause limits a Customer's rights under Australian Consumer Law or prevents a Customer from pursuing any remedy otherwise available at law.
